Officers with the Warsaw Police Department investigated the following accidents:

11:12 p.m. Saturday, Dec. 12, North Detroit Street, north of Lyon Street, Warsaw. Driver: Erica R. Bibler, 17, West CR 250S, Warsaw. Bibler saw the lights for the operating a vehicle while intoxicated checkpoint and as she was passing by she was looking at the lights. Her vehicle crossed the center line and veered into the other lane hitting a parked sheriff’s department vehicle, registered to the Kosciusko County Commissioners, Warsaw. Damage up to $25,000.

1:26 p.m. Friday, Dec. 11, Lake City Highway, east of East Center Street, Warsaw. Drivers: Daniel L. Swafford, 23, Walnut Street, Claypool; Rene Perez, 41, Dover Drive, Elgin, Ill.; Larry A. Marhanka, 67, Felix Place, Plymouth, and Nelson M. Ford, 45, Erie Drive, Crown Point. Perez complained of pain to the back. Swafford was westbound in his vehicle and pulled into far left turn lane, hitting the Perez vehicle. Swafford put his vehicle in reverse to flee the scene, backed up and attempted to merge back onto highway, colliding with the Marhanka vehicle and left the scene. After the impact with the Marhanka vehicle, his vehicle was forced into Ford’s vehicle. Police located Swafford and was placed into custody admitting to being under the influence of narcotics and failed to provide proof of insurance. Swafford was arrested forf ailure to stop after an accident, operating while intoxicated, possession of marijuana, driving while suspended, operating a vehicle without financial responsibility, probation violation and possession of paraphernalia. Damage up to $5,000.

12:52 p.m. Friday, Dec. 11, East Center Street, east of Eastlake Drive, Warsaw. Drivers: Ashton L. Jones, 21, East CR 400N, Huntington, and Marissa A. Evilsizer, 19, South 600E, Columbia City. Jones attempted to merge into the left lane, failing to see the Evilsizer vehicle. Damage up to $5,000.

11:56 a.m. Friday, Dec. 11, West CR 300N, Warsaw. Driver: Anna L. Summerlot, 24, East McKenna Road, Warsaw. Summerlot was turning her vehicle into a parking space and oversteered, hitting a parked vehicle registered to Stephen C. Fredericks, Janewood Court, Goshen. Damage up to $2,500.

He Used A Friends Checking Account, Debit Card Without Permission

SYRACUSE — Michael James Kausal, 51, 27 EM D18A1 Lane, Syracuse, was arrested Saturday evening, after charges were filed against him when he took a check from a friend, wrote the check out to himself and forged the friend’s name. He also used that friend’s debit card for a purchase.

Kausal has been charged with forgery and fraud, both level 6 felonies and theft, a class A misdemeanor.

Documents filed in Kosciusko Superior Court 3 state on Sept. 16, a woman advised while checking her bank account, she found where a check had been written out to a former friend in the amount of $140 without her permission or consent. The check had also been cashed. She had contacted the Kausal about writing the check and cashing it. Later $130 was deposited back into her account.

Police obtained a copy of the check and compared her signature with that on the check, finding it did not match. She also reported on Sept. 8, her debit card was used to purchase $9.95 in cigarettes at Casey’s Gas Station in Syracuse, also without her permission or consent.

Kausal admitted to police he had cashed the check and used the debit card.

He is being held on $5,000 surety and $250 cash bond.

WARSAW — Warsaw Community School Corporation is another step closer to bringing its dream of a new Lincoln Elementary and renovated Washington Elementary and Edgewood Middle School a reality.

Warsaw Plan Commission unanimously approved development plans on all three school projects Monday evening, Dec. 14, during its regular meeting. No negative remarks against the project were heard from commission members or the members present, only questions concerning traffic at Washington and Edgewood.

Jeremy Skinner, city planner, stated the development plans meet the city’s requirements. Meeting over six months to discuss traffic flow and movement, Lincoln school’s design fitting into a neighborhood with the least amount of impact were worked out. “We will continue to work with them on the sewer line that runs through the site for a good resolution to the issue,” Skinner said about the Lincoln site.

Traffic flow, detention ponds, setbacks, construction time frame, and Lincoln School projected student enrollment were topics discussed.

Only two residents, Bill Pochron who resides near Washington and Edgewood and Tyler Moore, who resides near Lincoln, provided comments to the commission. Both expressed concern over traffic issues. Pochron’s concern focused on the twice daily congestion in the area around both Edgewood and Washington, not only on immediate streets of Kincaid, Union, Logan and Fisher, but also Winona Avenue. “I can’t get out of the driveway,” he stated.

Moore questioned the impact of traffic near Lincoln at Colfax and Main asking if the city has looked at installing some type of stop device. “Traffic comes flying by that corner … It’s nasty, you can’t see through Ace Hardware,” Jim Gast, commission member, agreed adding traffic has been looked at before and the city will keep an eye on it.

Skinner noted the discussion has focused on keeping the bulk of the traffic on those streets designed to handle the traffic load — Lincoln, Logan, Fisher, Winona Avenue. At Lincoln, the traffic will be kept to Lincoln. At Washington, traffic will come off Logan and Fisher. Edgewood would utilize roadways within the school property.

“The school has done a good job reviewing (traffic),” stated Skinner. “From a traffic stand point this is the best scenario to utilize roads designed for such use and can be improved. Going forward we will look at improvements.” Skinner stated conversations can be held with INDOT concerning SR 15 and the timing of traffic lights, but there constraints on SR 15 due to it’s design and location.

Fencing, means of keeping students from being dropped off at locations other than those designated in the plans were also noted. At Lincoln, the two playground areas will be the only fenced off areas. Entrances will be controlled to those areas of drop off and pick up only. It was noted should there be issues of cars stopping at other areas, there are remedies — police presence — to handle those situations.

Construction is expected to be completed by the end of 2016.

The development plans were presented by Colin Finch, civil engineer with Veridus Group, Indianapolis. Starting with Lincoln School, Finch’s presentation showed an overview of where the new school will be built, the increased parking area in front, traffic pattern coming off Lincoln Street and off street parking for buses off Main Street.

At Washington, Finch pointed out the addition of classrooms, new drop off area, additional parking area in front of the school and around the administration building and drive coming from Tiger Lane in front of the administration building and school. The plans included the projected traffic flow on the school campus, which included ingress and egress from Kincaide Street.

At Edgewood the new front entry, new bus parking areas were pointed out with a new one-way drop off area. Finch noted the new entryway at Edgewood will make it an obvious entrance with a canopy. It was noted that bus traffic will be kept to the south of the building and parents will be entering from the east side.

During other business the commission members were given introductory information concerning recovery homes, as well as definitions from within the city’s zoning ordnance. Tim Dombrosky, assistant city planner, noted there has been issues with the current ordinance structure and how it handles certain housing uses. The commission will be presented more information in January.

Commission member Mike Klondaris noted that evening was his last meeting as a commission member as he will be moving to the redevelopment commission. Diane Quance will be serving in his position as the council representative.

The next meeting of the commission will be at 7 p.m. Monday, Jan. 11.

Jury Trial Canceled, Defendant Fails To Appear

WARSAW — The start of Dustin Edward Owens’ two-day jury trial, who has been charged with two counts of child molesting, a class A felony and a level one felony, was delayed this morning, Dec. 15. The case was ultimately canceled and a bench warrant was issued for his arrest after Owens failed to appear for his own trial.

Thirty minutes after what was to have been the start of jury selection, a brief hearing was held in Kosciusko Superior Court 1 to address the absence of Owens. The prosecution made the request for members of the sheriff’s department go to Owens’ last known address to check on his welfare and safety. His last known address was 10402 S. SR 15, Silver Lake.

Jay Rigdon, attorney for Owens, stated his office had spoken with Owens late yesterday and confirmed Owens knew about his trial and received assurance he would be in attendance. “I am surprised he is not present,” stated Rigdon noting he did not want to make witnesses and jury members wait. Rigdon asked for a continuance until it was known why Owens was absent. Rigdon welcomed the safety check of his client.

Superior Court Judge David Cates denied the continuance and sent officers to conduct the safety check, and if he was found safe, to bring him immediately to court.

After approximately an hour, police noted Owens could not be located. The judge then vacated the trial and issued a bench warrant.

Short Meeting For Warsaw Park Board

WARSAW — It was a short, yet productive, meeting Tuesday evening Dec. 15, for the Warsaw Park Board.

Approval was given to sign another year’s lease with the Kosciusko County Council on the Aging and Aged for use of the Pete Thorn Center at Lucerne Park. The yearly lease is $1,053 per month. Wayne Township also provides $26,000 a year toward KCCAA’s use of the facility.

David Neff, executive director of the KCCAA, presented a short overview of three programs offered to county seniors. These programs included the delivery of over 100 mobile meals daily, provision of van transportation to medical appointments and creation of recreational activities at the senior activity center. The center serves daily meals through REAL Services. Neff stated for $5 a year, seniors can participate in a variety of activities.

Gift Certificates Approved

Sheila Wieringa, recreation director, received approval to offer gift certificates for park department programs and activities. The certificates, which must be used within the year of purchase, are available in any amount and toward any program or activity. “There is no cash value,” she stated. The certificates can also be used for a partial payment for an activity.

In addition, Wieringa presented the activities report. She stated for Light Up The Night, Dec. 4, 500 glow necklaces were handed out in the first 15 minutes of the event. She estimated up to 2,000 people participated along with elementary choirs from Eisenhower, Jefferson and Leesburg schools. There were 600 participants at the Christmas Countdown event, Dec. 11. Goody bags were distributed to 280 kids who enjoyed cookies, reindeer games and made cards for soldiers. Those cards, she stated, were mailed out Tuesday.

Wieringa noted 2016 sponsorships are starting to come in with $6,000 already received. “We’re off to a good start,” she said.

Shaun Gardner, maintenance, reported light preparation for the Central Park Holiday Light Display began mid-October, with all lights hung by Thanksgiving. He noted new displays were purchased, through a donation from the 2014 Young Tigers concession stand. Among the new displays are two toy soldiers, two LED displays and Santa in a tractor throwing toys in a wagon.

Earlier in the meeting, Larry Plummer, superintendent, introduced Wieringa and Heather Frazer, new administrative assistant, to the board. Wieringa had been the administrative assistant for four years, stepping into the recreational director’s position after the resignation of Liz McKinney. “She has enthusiasm and new ideas for programming,” Plummer stated. Frazier, he noted, came to the parks department after working with the police department for a number of years. “She fits right in and we look forward for many years to come.”

During other business Rick Packowski, board member, was appointed to the Warsaw Plan Commission as a representative of the park board.

Board member Diane Quance inquired if the greenway had the same hours of use as city parks. Plummer stated it did not follow the park rules and no city ordinance was known regarding hours. However, deer have been seen running through the greenway after dusk and users of the walkway, should use caution.

Warsaw Man Charged With Welfare Fraud

WARSAW — John L. Cantrell, 51, 809 E. Clark St., Warsaw, was arrested Tuesday evening, Dec. 15, on charges of welfare fraud, a level 5 felony.

Documents filed in Kosciusko Superior Court 1, on Nov. 25, state on Dec. 2, 2010, Cantrell applied for unemployment compensation benefits. He reported he had been laid off from his job. Through Dec. 4, 2010, and March 7, 2015, Cantrell received benefits of $390 per week.

Court records show in order for Cantrell to receive the compensation benefits, he was required weekly to submit, to the Indiana Department of Workforce Development, vouchers certifying he remained unemployed, had no earnings or accurately report full or part-time wages earned for the weeks he was claiming benefits.

In January and March of 2015, IDWD Investigator Cheryl Riley inspected payroll records relating to Cantrell’s claims. Riley found there were weekly earnings, from RR Donnelley & Sons Company, corresponding to weeks Cantrell received unemployment compensation benefits.

It is alleged Cantrell did not properly report his employment and earnings from RR Donnelley to IDWD and falsely certified his earnings and/or that he was unemployed for 130 weeks, when he was actually drawing wages.

Between Dec. 4, 2010 and March 7, 2015, it is alleged he received $43,845 he was not entitled. IDWD also states there is $29,638 in penalties and $1,872 in other overpayments against him.

TFI Praises House Plan to Fund Medicaid with Increased Tobacco Tax

INDIANAPOLIS — Officials from Tobacco Free Indiana, a coalition of national and state health organizations, praised a plan released today, Dec. 16, by Indiana Speaker of the House Brian Bosma that would generate revenue to increase Medicaid funding by increasing the tobacco tax.

“We’re pleased that House GOP members see the value in raising the tobacco tax,” said Monique Hill French, chair of Tobacco Free Indiana. “We look forward to working with Indiana legislators during the upcoming session to work for a one dollar increase in the tax — an increase significant enough to make an impact on the health of Hoosiers.

“Indiana is one of the 10 unhealthiest states in the nation and much of that is directly related to having one of the lowest tobacco taxes in the nation and an adult smoking rate that is six percent higher than the national average. Higher prices are one of the proven strategies to reduce smoking rates and improve health.”

Indiana’s current tobacco tax of $0.995 per pack is more than a dollar lower than most surrounding states and ranks 34th overall. The tax has remained unchanged since 2007. The adult smoking rate in Indiana is 22.9 percent, which is six percent higher than the national average. Research suggests that a 10 percent increase in tobacco prices leads to as much as a 7 percent decline in adult smoking rates.

American Lung Association Support

The American Lung Association in Indiana also supports the cigarette tax increase. An increase will help reduce the cycle of addiction to tobacco, it will help prevent a lifetime of addiction and will ultimately save lives.

As tobacco use continues to be the number one cause of preventable death in the United States, killing 11,000 Hoosiers and costing Indiana $3 billion in health care bills each year, the Lung Association in Indiana staunchly supports a cigarette tax increase by at least a $1.

Every 10 percent increase in the price of cigarettes reduces consumption by 4 percent among adults and 7 percent among youth.

The American Lung Association urges the Indiana General Assembly to significantly increase the cigarette tax.  A substantial increase to the cigarette tax in Indiana will keep kids from becoming an addicted adult smoker, help Hoosiers quit smoking and ultimately save lives.

  • 1:09 p.m. Tuesday, Dec. 15, 900 block South Union Street, Warsaw. Police investigated a bomb threat.

 

No Cause For Alarm, Just Out Of Fuel

NORTH WEBSTER — Concern spread through the North Webster area Wednesday evening, Dec. 16, when both the Circle K and Citgo gas stations were closed. Potential customers saw covers over gas pumps.

A check with sources in North Webster found there is no cause for alarm. The Citgo station, near the south edge of town, is temporarily closed while new registers are being installed. This caused an influx of business at the Circle K station on the north edge of town.

That influx resulted in Circle K running out of fuel and having to close its gas pumps. The tanks have been refilled and Circle K is ready for customers.

11:39 p.m. Wednesday, Dec. 16, South Detroit Street, south of East Winona Avenue, Warsaw. Drivers: Nathon M. Moran, 27, Boydston Street, Warsaw; Michelle L. Waters, 44, South Lotz Lane, Silver Lake; and Teresa M. Verteramo, 20, North Lindberg Street, Warsaw. Moran’s vehicle struck the back of the Waters vehicle, pushing the Waters vehicle into the back of the Verteramo vehicle. Damage up to $5,000.

4:18 p.m. Wednesday, Dec. 16, South Buffalo Street, south of West Prairie Street, Warsaw. Drivers: Jose E. Cruz, 22, West CR 250S, Warsaw; Lauren E. Hughes, 22, Ridge Hill Place, Fort Wayne; and Marlene K. Miller, 23, North CR 425W, Milford. Cruz’s vehicle struck the back of the Hughes vehicle. The force of the impact caused the Hughes vehicle forward, hitting the back of the Miller vehicle. Cruz was cited for driving while suspended. Damage up to $10,000.

4:13 p.m. Wednesday, Dec. 16, North Detroit Street and Lake City Highway, Warsaw. Drivers: Kendall E. Rodgers, 21, East Barrington Place, Warsaw, and Kimmie S. Graham, 52, East Garfield Street, Warsaw. Rodgers was checked by paramedics but not transported. Rodgers vehicle struck the back of the Graham vehicle. Damage up to $10,000.

2:21 p.m. Wednesday, Dec. 16, Chinworth Court, Warsaw. Driver: Jill A. Farster, 40, Chinworth Court, Warsaw. Farster backed into a parked vehicle. Damage up to $1,000.

1:25 p.m. Wednesday, Dec. 16, North Parker Street, Warsaw. Drivers: Lassie Lewis, 59, South CR 600E, Pierceton, and Karen E. Kvidera, 55, EMS B60 Lane, Warsaw. Lewis overcorrected while driving into a parking space, hitting the Kvidera vehicle. Damage up to $2,500.

1:08 p.m. Wednesday, Dec. 16, East Winona Avenue and South Indiana Street, Warsaw. Drivers: D.M. Loher, 40, Austin Drive, Warsaw, and Debra S. Showley, 43, South CR 400E, Warsaw. Loher’s vehicle struck the back of the Showley vehicle. Damage up to $5,000.
