Joshua J. Surface
Joshua Julian Surface, 42, West Perry St., Warsaw, will appear back in in Kosciusko County Superior Court at 8:30 a.m. Oct. 16, for sentencing.
Surface pleaded guilty earlier in the week to three counts of child molesting, each a class A felony. However, he has entered a plea agreement.
The plea agreement asks the three counts be dropped to B felonies and the sentence, if accepted, run concurrent with each other.
The plea agreement additionally states that while there is no limitation to the sentence given, he seeks to be sentenced as a Credit Restricted Felon, as the conduct involved in all counts involved the defendant being over the age of 21 and the victim less than 12 years of age.
The affidavit of probable cause states Warsaw Police were notified on June 24, 2013, that a juvenile was having a sexual encounter with an adult. The sexual encounters occurred between April 27, 2013 and June 22, 2013. The juvenile was under 14 years of age.
